Chapter 12.12. SIDEWALK CONSTRUCTION |
§ 12.12.020. Construction of new or replacement sidewalks by adjoining property owners.
The owner of any property who desires to replace an existing sidewalk within the adjacent public right-of-way or to construct a new sidewalk within the adjacent public right-of-way where none currently exists may construct a new or replacement sidewalk, but only under the following conditions:

The owner of adjacent property may not construct a new or replacement sidewalk within the public right-of-way without the prior consent of the village board.

Except as otherwise determined by the village board, all sidewalks constructed in the public right-of-way shall have a width of sixty inches and a thickness of no less than four inches except that any portion of a sidewalk crossing a driveway or an alley shall have a thickness of not less than six inches. The village board retains the discretion to allow the construction of new or replacement sidewalks with a width of less than sixty inches if a lesser width is consistent with the prevailing width of sidewalks which already exist in the area adjacent to the proposed construction.

Except as otherwise determined by the village board, any such sidewalk shall be constructed with Portland cement concrete in accordance with the specifications of the Illinois Department of Transportation as found in the latest edition of the "Standard Specifications for Road and Bridge Construction."

Any such sidewalk must be installed by a concrete contractor or other qualified person approved by the village board.
Provided that the village board concurs with the need for the construction of a new or replacement sidewalk and provided that advance approval of the project is obtained from the village board, the village shall pay the cost of the concrete used to construct the sidewalk at typical rates charged for ready mix concrete on the date of installation based upon the volume of concrete as measured or determined by a representative of the village. The village shall not pay the cost of any portion of a driveway approach other than that portion thereof utilized for sidewalk purposes. The village shall not pay the cost of any sidewalk constructed on private property.
