§ 15.40.416. Designation as "unfit for human habitation."

  • The village's director of the building inspections department or his agent, shall designate a dwelling, dwelling unit or rooming unit as "unfit for human habitation" when the structure is damaged, decayed, dilapidated, unsanitary, unsafe, vermin-infested, lacks illumination, ventilation, or required sanitation facilities to such an extent as to create a clear and present danger to the health, life and safety of occupants, but has not yet reached such a state of complete disrepair as to be condemned as a dangerous structure as herein provided, he/she may declare such a structure as unfit for human occupancy, if repairs or corrections have not taken place within seventy-two hours after receipt of notice of violation of this chapter. In such cases, the director of the building inspections department shall order the structure to be vacated.
