§ 15.40.532. Affirmative defense for the appellant.

  • Two possible affirmative defenses to the offense:

    A.

    Full correction of each and every violation charge against the defendant and upon request of the defendant, approved by the director of inspections prior to trial, shall be affirmative defense to this offense.

    B.

    The current occupant has refused entry to the owner or his agents or employees to that part of the dwelling or dwelling unit requiring correction, for the purpose of correcting the violation charged.
