 Chapter 15.42. WIND ENERGY CODE

  § 15.42.040. Permit required.

  • A.

    No WECS shall be constructed, modified or located within the corporate limits of the Village unless a special use authorizing the placement of the WECS has been approved pursuant to both the zoning code and this wind energy code and unless a building permit has been issued to the facility owner or operator approving construction of the system.

    B.

    No extraterritorial WECS shall be constructed, modified or located within the extraterritorial jurisdiction unless a siting permit authorizing the placement of the WECS has been approved as provided in this wind energy code and unless a building permit has been issued to the facility owner or operator approving construction of the system.

    C.

    An application to locate a large WECS within the corporate limits of the village or within the extraterritorial jurisdiction shall be accompanied by a fee in the amount of forty dollars per kw for each wind turbine which will comprises the large WECS. If a special use or a siting permit authorizing siting of the large WECS is approved, a building permit shall be issued without additional cost. The village may at its option waive the application fee with respect to an application submitted by a unit of local government or a school district.

    D.

    Any application to locate a small WEGS within the village or within the extraterritorial jurisdiction shall be accompanied by a fee in the amount of one thousand dollars. If a special use or a siting permit authorizing siting of the small WECS is approved, a building permit shall be issued without additional cost. The village may at its option waive the application fee with respect to an application submitted by a unit of local government or a school district.

    E.

    Any physical modification to an existing and permitted WECS that materially alters the size, type or number of wind turbines or other equipment shall require a modification of the special use under this Code. Like-kind replacements of existing wind turbines shall not require a modification of the special use.
