§ 15.44.040. Building operations.

  • It is unlawful to engage in the erection (including excavation), construction, demolition, alteration or repair of any building or other improvement to real estate if the same is accompanied by loud or annoying noises other than between the hours of 7:00 a.m. and 8:00 p.m. Monday through Saturday except under the following circumstances:

    Such operations may be conducted in the case of urgent necessity in the interest of public health and safety:

    Such operations may be conducted in commercially or industrially zoned areas of the city lying more than two hundred fifty feet from any structure used for residential purposes:

    C.

    Such operations may be conducted on Sunday between the hours of 7:00 a.m. and 8:00 p.m. by an occupant of residential property on such residential property: provided, however, that such operations may not be conducted on more than two Sundays during any three-month period and, provided further, that such operations may not be conducted within two hundred fifty feet of a church while services of any kind or nature are being conducted at such church. For purposes of this section, the term "occupant" includes individuals who assist an occupant without monetary compensation for such assistance.
