§ 5.28.200. Violation of Article II.

  • Any person, firm or corporation convicted of violating any provision of Article II of this chapter, pertaining to exhibition permits, shall be fined not less than one hundred dollars and not more than five hundred dollars, except that the third and all subsequent convictions within any twelve-month period shall be a misdemeanor, and the person, firm or corporation convicted thereof shall be fined not less than one hundred dollars and not more than five hundred dollars and imprisoned in the county jail for a period not exceeding six months. A separate and distinct offense shall be regarded as having been committed for each exhibition of each motion picture or part thereof without a permit.
