§ 6.24.100. Certain animals prohibited in the village.
A.
Except as provided in subsections B. or C. of this section, it is unlawful for any person to own, possess, keep or permit within the village any of the following animals: horses, cattle, sheep, ponies, mules, goats, pigs, swine, hogs, ducks, geese, chickens, minks, skunks, or any other hoofed animal or poultry not herein specifically mentioned or any undomesticated feline, canine or ursine animal or any other undomesticated animal potentially injurious to mankind.
B.
Certain livestock hereinafter described may be kept within the corporate limits of the village but only under the following circumstances:
1.
The livestock is located within the boundaries of two adjoining parcels of approximately equal size having a total area of not less than four and one-half acres and not more than five and one-half acres.
2.
The parcels upon which the livestock is located were annexed to the village after December 15, 2004 and before January 15,2005.
3.
Livestock shall not be located within twenty yards of the westerly boundary line of the parcel of the most westerly of the two parcels.
4.
No more than a total of two horses and twenty-five ducks may be located on either or both of the parcels at any one time.
5.
Horses which die or are sold or are otherwise disposed of may be replaced on a one for one basis with other horses.
6.
Ducks which die or are sold or are otherwise disposed of may be replaced on a one for one basis with other ducks.
7.
The right to maintain livestock on any parcel to which this subsection B. applies shall expire at such time as title to the parcel passes to anyone who is not a direct descendant of the person holding fee simple title to the property on January 1, 2005.
C.
Goats may be kept within the corporate limits of the village but only under the following circumstances:
1.
The goats are used for the purpose of controlling the growth of vegetation in and near stormwater detention facilities.
2.
The stormwater detention facilities where the goats are kept are fenced in such a fashion as to minimize the risk of escape.
3.
No permanent shelter for the goats is constructed.
4.
The goats may be present within the stormwater detention facility only between April 15 and October 31.
5.
Accumulations of manure within the stormwater detention facility are removed whenever necessary to control odor, flies or other insects.
6.
Not more than two goats may be present within any one stormwater detention facility.
7.
The village board approves a resolution finding that the presence of goats within the stormwater detention facility is unlikely to have an adverse impact on the use or enjoyment of nearby property. Any such resolution may impose such conditions on the keeping of goats under authority of this subsection C. as the village board in its sole discretion deems necessary to reduce the risk of that the presence of goats authorized by the resolution will have an adverse impact on the use or enjoyment of nearby property.
