§ 8.04.200. Establishment and operation of organic yard waste facility.
The director of public works may with the prior approval of the village board establish a facility for the purpose of receiving deposits of organic yard waste which facility shall be subject to the following regulations:
A.
The hours of operation of the organic yard waste facility shall be determined from time to time by the director of public works who shall conspicuously post the hours of operation on a sign located at the facility. It shall be unlawful for any person to deposit organic yard waste or any other materials at the organic yard waste facility at any time other than during the posted hours of operation.
B.
Only residents of the Village of Metamora may deposit organic yard waste at the organic yard waste facility. No organic yard waste collected by a contractor may be deposited at the organic yard waste facility. It shall be unlawful for any person not a resident of the Village of Metamora or for any contractor to deposit organic yard waste at the organic yard waste facility.
C.
Only organic yard waste may be deposited at the organic yard waste facility. Organic yard waste may be deposited at the facility only in areas designated by sign or by an employee of the village. It shall be unlawful for any person to deposit any material other than organic yard waste at the organic yard waste facility or to deposit organic yard waste at the organic yard waste facility at any location other than as designated by sign or by an employee of the village.
D.
Any person violating any provision of the section shall be punished by a fine of not less than fifty dollars and not more than seven hundred fifty dollars for each offense. Each day any violation of any provision of this section shall continue shall constitute a separate offense. The village board may also in its discretion seek prosecution by the appropriate law enforcement authorities for any conduct related to the operation of the organic yard waste facility which violates any applicable state or federal law or regulation.
