§ 12.08.080. Use and maintenance of alleys.

  • The following regulations shall govern the use of alleys within the village of Metamora which have not been vacated by the village board:

    A.

    Given the localized nature of the traffic which utilizes most alleys in the village, the village will maintain or improve only those alleys which in the judgment of the village board are regularly utilized by the general public. The village may at the discretion of the village board terminate maintenance of alley at any time.

    B.

    With respect to those alleys which the village board does not choose to maintain, the village relinquishes any and all responsibility for maintenance to the owners and/or occupants of property adjoining such alleys. The owner and/or occupant of any property adjoining an alley which has because of lack of use become overgrown with grass or other vegetation shall mow and maintain any such alley. The responsibility of an owner and/or occupant to mow and maintain an adjoining alley shall extend to the center line of the alley adjoining the property of the owner and/or the occupant thereof.

    C.

    The owner(s) and/or occupant(s) of any property who utilize an alley for access by motor vehicle to an adjoining garage, parking area or driveway shall maintain the alley in a condition suitable for travel by vehicular traffic through the application of crushed limestone rock to the surface of the alley and to potholes or ruts which may develop in the alley.

    D.

    No owner and/or occupant of property adjoining an alley which because of lack of use has become overgrown with grass or other vegetation shall construct a garage, parking area or driveway designed for access by motor vehicles through such alley without the prior written authorization of the village board. In the event such written authorization is received, the owner and/or occupant receiving such authorization shall pave that portion of the alley where vehicular traffic is allowed with crashed limestone rock.

    E.

    Except as otherwise permitted in this section, the passage of motor vehicles on, over or through alleys which have because of lack of use become overgrown with grass or other vegetation is prohibited; provided, however that such prohibition shall not apply to intermittent passage of motor vehicles owned or operated by or on behalf of an owner and/or occupant of property adjoining the alley where necessary for the purpose of transporting personal property to or from a rear yard adjoining the alley or for the purpose of performing repairs within an adjoining rear yard. The village board may at its discretion post signs in alleys subject to this section which indicate that motor vehicles are prohibited.
