§ 15.40.576. Inspections of dwellings.

    The village inspector shall develop an administration program and appropriate procedures for the inspection of dwelling units and other nonresidential structures, subject to the provisions of this chapter, and shall provide copies thereof to the president of the board of trustees of the village.

    B.

    Any owner, renter of lessor, within fifteen days prior to letting a dwelling or dwelling unit to the renter or lessee, may request the village inspector to inspect the dwelling or dwelling unit and to record its condition and the inspector's approval or rejection, as the condition may warrant.

    C.

    In any subsequent proceeding in the court by the owner against the occupant of a dwelling or dwelling unit for negligent damage thereto or by a renter or lessee against the owner for violation of this chapter, the director of inspections record shall be prima facie evidence of the condition of the dwelling or dwelling unit at the time of letting; provided, that the occupant takes possession of the dwelling or dwelling unit within seventy-two hours of the director of inspections' inspection.
